Man gets prison after passing out behind the wheel - Escanaba Daily Press

MENOMINEE — A Wisconsin man was sentenced to up to five years in prison Friday after being found passed out behind the wheel at a Menominee City intersection last year.

Donald A Paul Nichols, 60 of Janesville, Wis. was sentenced to two to five years in prison for his sixth drunk driving offense, according to a press release issued Sunday by Menominee County Prosecuting Attorney Jeffery T. Rogg. The sentence was handed down on Dec. 4 by 41st Circuit Court Judge Christopher S. Ninomiya.

Nichols pleaded guilty on Sept. 8 to a single count of Operating Whole Intoxicated, Third or Subsequent Offense. The charges stem from an incident that occurred on Aug. 4, 2019, when Menominee Police Department Sgt. Hames Harper and Officer Jamie Rivett found Nichols passed out behind the wheel of his running vehicle at the intersections of West Drive and 18th Avenue in Menominee. Nichols was “unable to stand up” when he was extracted from the vehicle and admitted to officers that he had been “drinking whiskey and consuming alcohol all day” at the Waterfront Festival, according the Menominee Police Department incident report related to his arrest.

A Michigan State Police analysis of Nichol’s blood following his arrest showed a .19 BAC.

“Mr. Nichols is a serial drunk driver,” said Rogg. “His sentence needed to reflect the seriousness of the offense and promote respect for the law,” Rogg added, noting Nichols had seven previous felony and seven misdemeanor convictions.

“Judge Ninomiya has sent a very clear message to Mr. Nichols, and the citizens of our community whom he put in danger, that our government will not tolerate continued defiance of the legal obligations imposed upon him in a civilized society,” Rogg continued. “The only thing that can stop some people is a prison sentence, because the citizens of our community are simply not safe with this defendant continuing to put them at risk from his actions. I appreciate Judge Ninomiya supporting me, by this prison sentence, in protecting the citizens of Menominee County.”
